民族民间传统文化的知识产权保护模式新探

本文在我国现有的知识产权法制度框架下,着力探讨了保护民族民间传统文化的两种新模式即商标权保护模式和专利权保护模式,并结合民族民间传统文化的特点从理论上对这两种保护模式进行了粗浅的制度构建。

The New Exploration of intellectual property protection mode for the Traditional folk culture

Traditional folk culture as the working people's intellectual,although its applicability of intellectual property rights protection or privacy interests of a very controversial issue,but when they are carrying a suitable carrier or appropriate ways to display the time,as the strict sense of the intellectual property law to protect objects.Allalong,in the system of intellectual property law framework,the main protection mode for traditional culture is copyright protection,but such protection mode has its disadvantages.This article focus on the new protection model for traditional folk culture that is both trademark and patent protection mode in our existing system of intellectual property law framework,combining the characteristics of traditional folk culture, constructs the two protection mode shallowly and theoretically.
