| 摘 要： | 贝卡里亚作为近代刑法学的开山鼻祖，其恢宏博大的刑法思想与刑法理论是构建于社会契约论与功利主义哲学观基础之上的。而且贝卡里亚在继承启蒙思想家们的已有的社会契约论思想基础上，又为其增添了新的内涵，即指出社会契约论的精髓就在于民众的认同，而民众又是基于人性中所固有的趋利避恶之功利主义来认同社会契约的。

| Abstract: | As a founder of modern criminal law,Cesare Beccaria put forward his criminal law ideas and theories based on social contract and Utilitarianism.Nevertheless,it should be noted that Beccaria added something new as he stressed the role of public recognitions for social contract through the human instinct of profit-gaining and loss-avoiding. |
