哈耶克宪法模式批判

Criticizing Hayek's Constitutional Model

There is no doubt that the constitutional model by Hayek has enlightened us most.His defence of common law,criticism on contemporary parliamentary democracy and innovation of constitutionalism institution involve the core of contemporary liberal democratic political system.However,there are three major problems in Hayek's constitutional model:the theory of common-law legal state he suggested embodies some contradictory points,his unique interpretation of the principle of separation of powers is different from the opinion of classical political theorist,and Hayek's instrumental democratic ideas results in a simple judgement of democratic system and its value.
