| 摘 要： | 在先履行方利益保护问题历来是双务合同中的一个大问题。大陆法系的不安抗辩权与英美法系的先期违约制度在保护双务合同在先履行方利益方面各有优缺点。我国《合同法》同时移植两种制度的做法是立法模式上的一个伟大创新,具有无比的优越性。但由于认识上的局限性,我国《合同法》所确立的在先履行方利益保护机制也还存在某些明显的缺陷,需要适时的修正与完善。
