| 摘 要： | 当代程序简易化改革中,西方国家普遍建立了小额诉讼制度。即将修订的我国民事诉讼法也应当增设独立的小额诉讼程序。在借鉴国外立法例的基础上,从小额诉讼程序的适用范围、管辖权、当事人的程序选择权、审级制度及救济程序等方面对该程序的建构进行了探讨。

| Abstract: | Contemporary reform in procedure simplification has seen establishment of the petty lawsuit procedure in most western countries. The prospective amendment of the civil procedure law in China should also include the special petty lawsuit procedure. With reference to the best practice from foreign countries, the present paper inquires into the construction of the procedure covering its scope of application, jurisdiction, the right to choose procedure by the parties involved, trial level and remedy. |
