| 摘 要： | 源自美国的辩诉交易虽从其产生时起就伴生着诸多争议,但长期的司法实践表明辩诉交易不仅在英美法系国家,而且在大陆法系国家都得到了充分地运用,并在一定程度上呈普遍发展的趋势.本文深入剖析了产生这种趋势的原因,并论证了我国借鉴辩诉交易的必要性和可行性,提出了设立控辩协商制度的初步构想.

| Abstract: | Although plea bargaining has involved doubts and debates ever since it came into existence in the United States, the present practice of justice has proved that the plea bargaining has been universally employed not only in the countries of the common legal system but also in those of the civil legal system, and to some extent it is on a widespread rise. The paper aims at analyzing the causes of the phenomenon, arguing for the necessity and feasibility to employ plea bargaining in China and trying to bring forward a primary concept of "plea negotiation" system. |
