论行政诉讼原告资格转移制度设立的目的

行政诉讼原告资格转移制度的设立,是为了保护原始原告的合法权利和与原始原告有直接利害关系的承继原告的合法权利。因为原始原告的合法权利受到行政机关的侵害,当其死亡或终止时,该权利并未消失,而是转化为身后权存在;同时,行政机关的违法行为可能牵连侵害了承继原告的权利,或者由于原始原告的死亡,而使承继原告因其死亡而得到的预期利益受损。正是因为原始原告和承继原告都享有合法权利,并且都存在该合法权利受具体行政行为侵害的法律事实,所以法律规定该项制度以切实保障二者的合法权利,避免出现合法权利得不到法律救济的情况。

The establishment of original plaintiff qualification transfer system in administrative litigation is to protect the legal rights of original plaintiff and legal rights of succeeding plaintiff related to original plaintiff.Because the legal rights of original plaintiff are invaded by administrative departments,when original plaintiff dies,the rights do not disappear but become the rights of dead person.Meanwhile,illegal behaviors of administrative parties may invade the rights of succeeding plaintiff and the rights of succeeding plaintiff may be invaded when original plaintiff dies.Because both original plaintiff and succeeding plaintiff have legal rights and because there are facts that the legal rights are invaded by administrative behaviors,the law has regulations to protect legal rights of both parties in order to avoid the invading of legal rights.
