农村土地承包中民主议定原则的实践分析

新中国成立以后,通过大量的实践和摸索,我国逐步找到了保护农民集体土地利益的有效方法———民主议定原则,并通过立法加以确立。该原则是实现村民自治,维护本集体经济组织成员合法权益,增强基层民主意识的重要途径,在保护农民集体土地利益方面无疑具有中国特色并且行之有效。通过结合司法实践,分析该原则在法律适用中存在的问题,提出行之有效的解决对策。

This principle, effective and of Chinese characteristics, is an in approach to achieve the villager autonomy, maintain the legal rights of members in the collec tive economic organization and enhance the democratic awareness of the grassroots. Based on the judicial practice forward the paper analyzes the existing problems in the application of the principle in the law and puts effective countermeasures.
