| 摘 要： | 为了达到均衡地保护当事人与第三人的利益的目标,赋予第三人相应的诉权是必然的选择.赋予第三人不同程度的参诉权决定了第三人参加之诉的类型与结构,对第三人利益保护的不同角度决定了是否于事后赋予第三人撤销权和第三人行使撤销权的不同方式.在执行程序中对第三人的两种类型的异议权的不同搭配方式决定了第三人执行救济制度的类型.

| Abstract: | In order to evenly protect the parties'interests and the third party's interests,it is necessary to give the third party litigation right.The different angles and degree of intervention rights enjoyed by the third party determine the style and structure of the third party joining lawsuit.The different angles of protecting the third party's interests determine whether the third party should be given rescission right after the event and the styles of exercising rescission right.In compulsory execution procedure,the arrangement ways of the different objection rightsof the third party determine the styles of the relief system of civil execution to the third party. |
