追寻理性的刑法变革

刑事法治之下，刑法变革既是根据犯罪结构及其变化趋势的立法强制性、法定化的过程，又是民众根据自身的传统、利益、价值观等，选择和创造的民主化、认同化的结果。而要构建一种强制化、法定化、民主化、认同化的刑法制度，刑法变革必须满足以下基本条件：准确反映特定社会的犯罪结构及其发展趋势；真实反映不同群体的各种现实利益关系；充分反映民众共同的价值观；取得刑法文化上的正当性。而此，正是人类追求刑法变革的应有理性。
