刑事合意证明模式研究

证明模式与诉讼模式密切相关,诉讼模式的转型必然引起证明模式的变革。随着体现控辩双方合作、协商与合意的协商型刑事诉讼模式成为一种独立的制度形态,刑事证明模式也相应地呈现出合意取向。控辩双方在取证、举证等证明环节上开展一定程度的合作与协商,形成一种新型证明模式,即合意证明模式。合意证明模式与传统分立证明模式在证明目的、证明主体的地位、事实认定结构、证明方式等方面具有较大差异。刑事合意证明模式为刑事证据契约提供了理念支撑及制度依托,刑事证据契约是合意证明模式的实现途径。

The mode of procedure and the mode of proof are connected intensely.It is inevitable the convert of the mode of procedure results in the reform of the mode of proof.With the mode of procedure has become an independent system form which reflects cooperation and consultation between prosecuting party and defense party,the mode of proof has also showed the contract orientation.The prosecuting party and the defense party carry on cooperation and consultation at the segments of obtaining evidence and adducing evidence.There are many obvious differences in the consensual mode of criminal proof and the split mode of proof,such as the objective of proof,position of proof subject,the structure of determine facts,and the form of burden of proof,etc.Consensual mode of criminal proof provides a theory support for the contract of criminal evidence,while the latter is a way to practice consensual mode of criminal proof.
