| 摘 要： | 清朝末年,清政府在内忧外患的严峻形势下,发动了一场前所未有的社会和法律变革。此次变革最直接、最深刻的动力不是经济基础的变化,而是来自政治、外交、文化的冲击。此次修律,也取得了巨大的成果,不仅在法律制度上,而且在法理念上对传统法都有所突破,对后世产生了深远的影响,在中国法制现代化进程中占有重要地位。
