行业协会的反垄断法规制

在全球化的第三部门兴起的语境下，作为非营利性中间社团法人的行业协会无疑将显示其独特的功能，但是在中国“双重管理”的社团治理模式下，其弊端在竞争法的视野中也逐步凸显，而作为经营者的行业协会完全能够从事限制竞争行为，从而成为《中华人民共和国反垄断法》的规制对象。

The Regulation of Anti-Monopoly Law on Trade Association

In the context of globalization, the third department is booming. Trade association, as the legal person of non-profit community, will undoubtedly show its unique function. However, governed by the dual management mode in China, it is evident that its shortcomings become visible from the perspective of Competition Law. Being an enterprise, it is possible for trade association to take part in limited competitive activity and become the regulated object of Anti-Monopoly Law.
