我国环境保护公众参与的制度建设回溯与展望

中国环境法治发展40年,也是环境保护公众参与制度发展和建设的40年。我国环境保护公众参与制度建设从无到有、不断发展完善,逐渐形成由知情权、参与权、监督权构成的环境保护公众参与权利体系和公众保护生态环境的义务规则。总结经验,公众参与是我国生态文明制度建设的重要内容,是实现公民环境权利的题中之义,是提升环境决策质量的重要保障,是调动公众环保力量的必然路径。面向未来,广义层面的公众参与应当注重提升公众参与生态文明建设的自觉性和主动性;狭义层面的公众参与应当通过完善主体界定、推动信息流动、推进协商参与和加强社会监督等实现进一步完善。
