| 摘 要： | 在戊戌前后法制现代化进程中,西方政治法律文化的东渐实质上是一个近代中西政治法律文化冲突和融合的过程,也是近代中国法制现代化思想启蒙的过程。在“西法东渐”过程中,戊戌前后处于转型中的新知识分子扮演着极其重要的角色,起着独特的作用,对推动近代中国法制现代化进程产生了深刻的影响。

| Abstract: | China began its modern legal system building in 1898.The import of western politics,legal system and culture is a result of conflict and fusion between western and oriental ideas of politics and legal system.It proved to be the enlightenment period of China's legal modernization.The intellectuals under transformation in this period played an important role and greatly facilitated the modernization drive of the legal system in modern China. |
