论涉外侵权行为的法律适用

自20世纪以来,随着各国间交往的日益密切以及科技的快速发展,涉外侵权案件数量增长迅速,完善的涉外侵权法律适用规则对于公平合理地解决涉外侵权案件至关重要。通过研究涉外侵权行为的法律适用的基本理论问题,本文分别对传统涉外侵权的法律适用、侵权行为法律适用的新发展和特殊侵权行为的法律适用三个方面进行了阐述。最后,本文针对我国不久前颁布实施的《中华人民共和国涉外民事关系法律适用法》中涉外侵权的规定,对其中的几点不足之处提出了建议。

On the Foreign Law Applicable to Tort

Since the twentieth century, numbers of foreign-related tort cases are increasing significantly along with the frequent international association and fast development of science and technology, so a perfect foreign-related tort law is of greatest importance in solving these cases in a fair and reasonable way. Based on fundamental theories, the article makes a thorough study on the foreign-related tort law in three parts, including the application of traditional foreign-related tort law, the new development of the application of tort law and the application of law in special tort conduct. Combined with the legal regulations concern the foreign-related tort in the recently promulgated ＂ The law of the Application of Law for Foreign-related Civil Relations of the People＇ s Republic of China＇, the article puts forward some suggestions.
