我国群体诉讼制度构建的法经济学思考

虽然我国现行民事诉讼法明确规定了解决群体性纠纷的代表人诉讼制度。但由于人们在对群体诉讼的价值和功能的理解上存在许多误区，导致大部分法院并没有按照法律规定的代表人诉讼程序来处理群体性纠纷，而是采用传统的诉讼方式分别处理，这一做法不仅违背立法宗旨，也与群体诉讼制度设计的初衷（基于诉讼经济和司法统一的目的）严重背离。因此，探究群体诉讼制度创设的价值功能与其所期达到的目的，对深化我国群体诉讼的理论研究、指导群体诉讼的司法实践及推动相应制度变革，都具有重要的意义。

The System of Group Litigation Based on Laws and Economics

Although the commissarial lawsuit of civil procedure law in our country can set out a great deal of group disputes, there are still some misunderstandings on the value and the function of the group lawsuits and our traditional lawsuit models have been used to settle these disputes individually. This approach not only conflicts with the legislative purpose, but also seriously deviates from the original intention of the system groups. Therefore, with the view to deal with the new kind of modern group disputes properly and make the cost of lawsuits consistent with the benefits of it, it is worthwhile to research the function and the aim of the group lawsuit system. With the research, we will bring forward some new ideas, which should be suitable for our group lawsuit system, to clear away the obstacles and remedy the deficiencies in China's judicial practices.
