我国法理学发展中应注意的几个问题

当前我国的法理学要健康而迅速地发展,必须注意克服以下几个问题或处理好以下几个关系(1)要处理好法理学研究与政治需要的关系,要使法理学研究保持相对的独立性;(2)不要急于立门户、分学派;(3)要处理好立足国内和面向世界的关系;(4)要处理好传统理论与现代观念的关系;(5)要正确地对待分歧和争论;(6)要处理好学科建设和课程建设的关系;(7)要处理好法理学研究中的总体理论构思和局部研究的关系,不要急于建构理论体系和寻找核心概念;(8)要处理好法理学和法哲学的关系,要把法理学和法哲学区分开来.

Some Related Issues Concerned with the Development of China Jurisprudence

In order to make our jurisprudence develop efficiently and quickly,some related issues and relations should be paid attention to:(1)the relationship between jurisprudence research and political demands,meanwhile keeping the independence of jurisprudence;(2)no hasty for the foundation of different academic schools;(3)the relationship between domestic research and international communication;(4)the relationship between traditional theories and modern conceptions;(5)correct attitude towards various divergences and arguments;(6)the relationship between the construction of subject and lessons;(7)the relationship between the whole and local research of jurisprudence,no hasty for the construction of theoretical system and key conceptions;(8)the relationship and distinction between jurisprudence and law philosophy.
