我国设立简易破产程序的必要性可行性及路径研究

简易破产程序是一些发达国家和地区审理小额破产案件所适用的一种程序。由于该程序用时短、成本低，可以满足破产企业快捷、低成本退市的需要，因此在破产法里设置简易破产程序具有积极的现实意义。设立简易破产程序不仅是完善破产法的需要，也是我国经济发展的客观要求，而即将于今年实施的新破产法并未设立简易程序。文章试图通过分析我国设立简易破产程序的必要性与可行性，探讨我国设立简易破产程序的基本路径。

A Study on the Feasibility of Establishing Simple Bankrupt Procedure and Its Path

The simple bankrupt procedure is an applicable institution that tries small bankrupt case in some developed countries and regions. It has effective affection to build simple bankrupt procedure in bankrupt law because it spends less time, low cost and satisfies bankrupt companies ＂needs. it is not only the need of consummating bankrupt law , but also meets the objective requirement of our economic development. But there are not simple bankrupt procedures in new law which will be carried out this year. Through analyzing the necessity and feasibility of building it, the article tries to discuss the method to building simple bankrupt institution in our country.
