论司法独立与党的领导的辩证统一

司法独立是司法公正的体制保障。司法公正是法治社会的主要特征,也是党的十六大提出的全面建设小康社会的目标之一。司法独立包括司法权独立、审级独立和法官独立。将司法独立与党的领导割裂开来、对立起来是一种偏见、误解。党的领导主要是政治、思想和组织的领导,而不是事无巨细越俎代庖。司法独立与党的领导并不矛盾,而是辨证的统一。

Judicial independence is the guarantee of a just judicial system.Fair judicature is the important feature of the legal society.It is also a goal of building a moderately well-off society in an all-round way.Judicial independence includes the independence of judicial power,the judgment independence and the judges' independence.It is a bias and misunderstanding to regard judicial independence and the Party's leadership as the opposites.The Party's leadership takes effect in politics,ideology and organization instead of the specific matters.The judicial independence and the Party's leadership are not contradictory,but are dialectic and unified.
