走出困境--对传统环境权学说的反思

面对严重的环境危机,人们提出环境权理论,并形成了基本人权说、财产权说、程序权说、人类权说等多种学说.但是以权利制约权利的构想不能够遏制环境危机.环境问题存在的根本原因,在于企业的外部不经济性.我们应当摈弃传统的方法和观点,以环境产权取代传统的环境权,这既是环境权的出路所在,也是从根本上缓解环境危机的有效途径.

Out of the Environmental Crisis -- The Introspection of Environmental Property Right Theory

In the face of the serious environmental crisis, people propose environmental right theory, and form kinds of theories, such as the basic human rights theory, property theory, procedure right theory and human right theory. But the idea of restricting right with right cannot alleviate the environmental crisis. The basic reason of the environmental question is the external uneconomy of the enterprises. We should abandon the traditional method and view, replace traditional environmental right with the environmental property right. This is not only the outlet of environmental right, but also the effective way of alleviating the environmental crisis fundamentally.
