近代舆论监督的兴起与言论出版自由权的法制化

舆论监督是现代法律监督体系中的一个重要组成部分。中国传统社会中并不存在近现代意义上的通过社会舆论来影响国家权力运作的舆论监督体制。随着在华外报的发展和西方资产阶级新闻思想的传入,国人开始对报刊等大众传播工具及其舆论监督作用有了初步的认识。清末民初,“言禁”、“报禁”逐渐取消,言论出版自由权得到了初步法制化。

The supervision on public opinions is an important part of legal supervision system.In the traditional Chinese society,there was not a system for public opinion supervision that could influence the state power.With the development of foreign language newspaper in China and the importation of western press theory into China,the Chinese have begun to realize the importance of public opinion supervision system.In the early period of the 20th century,the prohibition of free speech and press began to be abolished,and the freedom of speech and press has been legalized for the first time.
