| 摘 要： | 精神损害是对民事主体精神活动的损害,它造成民事主体精神痛若和精神利益的丧失或减损.必须依法认定侵权者的不法行为,确认精神损害的赔偿主体、索赔主体和赔偿的适用范围,同时依精神损害赔偿原则,给受害者予以适度赔偿.

| Abstract: | Spiritual damage is the damage to the civil body's spiritual activities that leads to the spiritual suffering and the total or partial loss of the spiritual benefits of the civil body. The illegal action of the infringer must be recognized according to the law. The body to amend for the spiritual damage, the body to claim the compensation and the scope of the compensation must be confirmed accordingly, thus compensating the sufferer properly based on the principles of spiritual damage compensation. |
