| 摘 要： | 本文从动产善意取得制度的起源着手,介绍了该制度在两大法系的发展,分析了该制度存在的理论依据和价值依据,力求清晰再现动产善意取得制度的历史沿革,探究该制度生命力所在,最后结合各国的立法经验,对我国未来民法典关于动产善意取得制度的规定提出了若干建议。 |
