加入WTO与中国商标法的修订

我国即将加入世贸组织,入世后中国的知识产权法面临着与国际知识产权保护接轨的问题.中国商标法是在计划经济体制下制定的,既不适应社会主义市场经济发展的需要,又不适应入世后与<与贸易有关的知识产权协议>相接轨.本文针对着我国商标法与贸易有关的知识产权协议的差距,从调整商标注册主体、注册商标的范畴、加强对驰名商标的保护、增加地理标志的保护等方面,论证了修订和完善商标法的现实性和必要性,以期作为商标法修订之参考.

China's Entry to WTO and the Revision of China's Trade Mark Law

With the entry to WTO, China's protection of intellectual property law must be in keeping with international protection of intellectual property law. China's t rade mark law was drafted under the planned economy system. So it cannot meet th e needs of market economy system, or keep up with the level of Trips. In view of the disparity between China's trade mark law and Trips, the paper concerns adju sting registered trade mark owners and the scope of registered trade mark, enhan cing the protection of well known trade marks and protection of place marks. Ta lking about the reality and necessity of revising China's trade mark law, the pa per offers a theoretical basis for legislature.
