| 摘 要： | 从企业法人财产权属于何种物权的羁绊中解脱出来,重新思索企业法人财产权定位对完善我国企业法人治理结构的意义,立足于物权的基本理论,在对企业财产的法律性质和企业法人财产权非物权性予以分析的基础上,应当得出企业法人财产权不应纳入物权体系的结论。

| Abstract: | It is very important for the perfection of the management of enterprise legal person to set free from the fetters of what the real right the corporative property right in enterprise belongs to and to deliberate its fixed position. The paper points out that the property right of enterprise legal person can not belong to the real right, based on the theories of real right and the analysis of the legal nature of the property right of enterprise legal person. |
