| 摘 要： | 土地家庭承包经营权的身份性和保障性制约了其可继承性，操作上的复杂性也使该权利的继承制度设计困难重重。随着承包地承载的保障功能逐渐减弱，该权利的身份性也将消解，继承将成为流转的常态；通过转让与出租该权利。可以解决继承带来的土地公平占有、土地进一步细碎化等问题。

| Abstract: | The identity of management right of contractual household lands and its guarantee have restricted inheritance.Operational complexity has also created many difficulties in designing the inheritance system.With the weakening of the guarantee on contractual lands,the identity of the contractual right will diminish.Inheritance will be a frequent way of transference;Transferring and renting the right will provide solutions to problems to be solved by inheritance,fair share and further division of land. |
