| 摘 要： | 权利优先于义务和责任,既是一个事实判断,也是一个价值判断。权利对于义务和责任既有逻辑上的优先性,也有道德上的优先性。其中,权利对义务和责任的逻辑优先性,意味着法律在创设规范时不仅以直接的方式宣告权利,而且法律上创设的义务和责任规范同时也意味着是赋予特定主体以权利。权利对义务和责任的道德优先性,意味着在法律创制行为规则时应当首先考虑对权利规则的创制,在司法过程中应当以权利救济和权利保障为核心,而不是首先确定义务和责任。坚持权利对义务和责任的优先性,是建设法治国家的基本要求,也体现了以人为本的政治诉求。
