| 摘 要： | 外国法查明制度在《中华人民共和国涉外民事关系法律适用法》中得到体现,并且进行了一定程度的创新,同时外国法查明制度可能在该法运行的过程中遇到一系列的挑战。通过分析中国国际私法规范中的外国法查明制度的利弊得失,从法律适用的视角评论了外国法查明制度的相关规范。在此基础上对中国的外国法查明制度进行了反思后发现,在外国法查明的对象、制度内涵、司法实践、学理探索等方面仍然存在问题,为该制度的改进和发展进行合理定位。
