农地经营权流转市场治理

完善农地经营权流转市场治理,引导农地经营权的有序流转,是实现农村土地适度规模经营的前提条件。根据诺斯的交易成本理论,对现阶段农地经营权流转市场下交易过程产生的成本进行了分析,并据此从农地经营权流转市场治理制度安排方面提出以下改进建议:第一,完善配套法律制度。在强化农户土地承包经营权的同时,完善农地经营权流转监管的法律制度。第二,完善土地流转市场机制。在供求机制上,一方面完善农村社会保障机制,另一方面以农户的利益为出发点创建多种形式的土地托管、股份合作办法,以激活供给侧。在竞争机制上,建立土地价格评估机制,发展土地流转中介组织。第三,完善土地流转制度。建立土地托管和土地股份合作等相关制度。

Research on Market Governance of Farmland Management Rights Circulation

Completing the market governance of transfer of management rights of contracted rural lands and guiding well organized transfer of management rights of contracted rural lands are the prerequisite for the realization of the appropriate scale of land operation in China. Based on North’s transaction cost theory,the research analyzed the transaction costs generated in the current rural land management right transfer market,and put forward the following improvement suggestions from the perspective of the market governance system.First of all,the government should improve the supporting legal system.With strengthening farmers’ economic right of land contractual operation,legal system for supervising the transfer of farmland management rights also needs to be improved.Secondly,the government should improve the land transfer mechanism.Specifically, from the perspective of supply, on the one hand,rural social security mechanism should be perfected;on the other hand,various forms of land trusteeship and share cooperation methods,which take the interests of farmers as the starting point, should be built up.From the perspective of competition,land price evaluation mechanism should be established,and developed land circulation intermediary organizations.Thirdly,land circulation system should be improved.The government should focus on the land trusteeship system and land share cooperation system, and establish related systems.
