| 摘 要： | 民族地区法制建设面临的最大问题是习惯法的适用。要充分发挥习惯法的积极作用,剔除其负面影响,必须在促进国家法与习惯法相融合的基础上加强应用研究,明确法制建设过程中习惯法的适用原则、适用条件及适用方式。
