再论竞争政策与产业政策调和机制的构建——从企业合并控制的视角看我国反垄断法的改进

如何处理好竞争政策和产业政策的关系以及当前我国反垄断法立法和执法应该如何构建协调竞争政策和产业政策的机制是我们面临的一个重大课题。产业政策和代表竞争政策的反垄断法之间不是非此即彼的关系,他们都是国家总体经济政策的一环,只是在具体适用范围、调整手段上存在着差别。反垄断法与产业政策之间应该是一个相互支持、相互补充、互动发展、拾遗补缺的关系。在反垄断法与产业政策并行的时代,建立产业政策与竞争政策的调和机制十分必要。我国反垄断法刚刚开始实施,竞争执法机关也刚刚建立,经验不足,具有可操作性的是借鉴台湾"公平交易法"的相关规定,对我国反垄断法作出修改,从而构建产业政策与反垄断法的调和机制,以实现竞争政策与产业政策的良性互动,发挥两者的综合协同效应,促进我国经济的平稳较快发展。

Another Discussion on Constructing Coordinative Mechanism between Competitiveness and Industry Policies

How to deal with the relationship between competitiveness and industry policies and how to make the legislation and enforcement of China's present Anti-monopoly Law construct coordinative mechanism between competitiveness and industry policies are an important task for China to face.Industry policies and Anti-monopoly Law representing competitiveness policies are compatible with each other.In other words,each of them is an important part of the country's general economy policies and their difference lies in the aspects of specific applicable scopes and adjusting means.They should support,complement each other and develop interactively.China's Anti-monopoly Law is just in its early stage of enforcement,so we can learn from relevant regulations of Taiwan's Fair Trade Law to modify it so that the coordinative mechanism between competitiveness and industry policies can be constructed.As a result,the effective interaction between competitiveness and industry policies can be realized and these two kinds of policies' coordinative effect can play its role in improving China's economy's smooth and rapid development.
