| 摘 要： | 缔约过失责任是在合同缔结过程中由于一方违反了诚实信用原则所应尽的义务而致使另一方的信赖利益遭受损失时所应承担的民事责任。从旅游合同的角度着重对旅行社缔约过失的表现予以阐述,并指出了旅行社缔约过失责任的赔偿范围,以期更好的保护旅游者的合法权益。

| Abstract: | Culpa in contrahendo is a theory,which has a deep influence on civil law area.But there is less research on Culpa in contrahendo in China,especially on travel agency's liability about culpa in Contrahendo in China's tour contract.That is the article aims at.After introduce the theory of Culpa in contraheddo,the article analyses its representation in China's tour contract.Then this article goes on probing into travel agency's legal liability of Culpa in contrahendo. |
