司法鉴定地方立法不规范现象研究

司法鉴定亟待立法一直是社会各界强烈的呼声。因此 ,黑龙江省、吉林省、重庆市、河南省人大先后通过了各自的司法鉴定地方法规 ,对规范一定范围内的司法鉴定工作起到了积极的作用 ,但也应该看到存在的问题和矛盾。本文以司法鉴定地方性法规为视角 ,将所存在的“不规范”现象进行比较研究 ,给正在立法的省、自治区、直辖市以借鉴和参考。

The Research in the Non - Uniform Issues of the Local Legislation on the Judicial Appraisal

The legislation of the judicial appraisal has been the issue that all levels in our society pay attention to. So some provinces such as Heilongjiang, Jilin, Chongqing and Henan have promulgated their respective local legislations on judicial appraisal, which have a positive influence on the judicial appraisal in a sense. But there are still some issues in them that we should be cautious of. This article has compared and researched the different issues and things of "non-uniform issues" among the different local legislation in order to give some useful information to the legislations which are making judicial appraisal laws.
