| 摘 要： | 澄清农地承包经营权的性质,具有重要的理论意义与现实意义.新近的债权论者提出了系统的论述,试图说明农地承包经营权是一种债权.然而,农地承包经营权并不因为其受发包人的限制,或者不具有可自主转让性,或者是在他人所有的物上设定而失其物权性质,因为它本质上是一种支配权而非请求权.
