| 摘 要： | 从民法物权法的基本法理出发,通过研究世界发达国家不动产登记制度的特点,结合中国现行立法实际,指出中国物权法不动产登记制度的立法价值取向,提出中国不动产登记法律统一化和登记机关一体化及采用以登记对抗主义为原则以登记要件主义为例外的立法建议。

| Abstract: | In view of the basic legal theory of property law of the civil law by way of studying the institutional characteristics in registration of real estates in developed countries in the world,the article points out the value selection tendency in the registration system of real estates and puts forward the principles of legal theory on the registration of real estate of our nation have to be abandoned and renewed,and furthermore,on this foundation,it makes suggestions that a uniform law on it should be set up on antagonism principle and prerequisite exception. |
