| 摘 要： | 上个世纪末以来,以Napster为代表的P2P软件的迅速兴盛,在导致P2P技术迅猛发展并打破了传统的以服务器为中心的互联网格局的同时,在版权领域也引发了一场又一场侵权与反侵权的较量。我们需要在详细解读P2P技术的基础上,从与P2P技术有关的行为性质入手,对哪些属于不侵权、哪些是直接侵权、哪些是间接侵权,进行界定,对P2P技术带来的版权侵权问题和对策作出较为全面和详细的研究。

| Abstract: | Since the end of last century,P2P software represented by Napster has been developing rapidly,resulting in the rapid development of P2P technology,and bringing about battles between infringement and anti-infringement in the copyright area.On the basis of a detailed explanation of the P2P technology,the article studies the characteristics of acts in order to determine which is non-infringement,which is direct infringement and which is indirect infringemenet.This article makes a comprehensive study of the copyright infringement problems and countermeasures-the subjects of the behavior,everyone's responsibility and so on. |
