我国政策性银行立法理论与实践研究

政策性银行立法必须坚持立足中国实际，遵循政策性银行自身规律，要着眼未来，制定一部体现创新思维和经济法、部门法属性的政策性银行保护法和监管法。实现规范政策性银行的组织和行为，保护政策性银行，加强政策性银行的监管，促进社会主义市场经济协调健康发展的目的。我国政策性银行法的立法应该坚持政策性、盈利性和适度竞争性三个核心原则；采取多行一法而不是一行一法，即制定统一的一部政策性银行法。我国政策性银行立法滞后的一个重要原因是政策性银行发展实践落后，河北省可以发挥省情和区位优势，建设政策性银行实践和试验基地，为政策性银行立法提供实践基础和素材。

Research on Theory and Practice in Policy Bank Legislation in China

The legislation of policy bank must meet the demand of the reality in china, follow the developing rule of policy bank, and look forward to the future. A policy bank law must reflect creative thoughts and the characteristics of economic laws, by which policy bank is protected and supervised so as to standardize the organization and activities of policy bank, reinforce policy bank supervision, and promote the development of the socialist market economy. Policy bank legislation in our country should adhere to the key principles of policy-embodying, profit-making and moderate competition. Legislative model should adopt ＂one law for all banks＂ instead of ＂one law for one bank＂, that is, making a uniform policy bank law. An important reason for the lagging of policy bank legislation is the lagged development of policy bank. Hebei Province may make use of its regional advantages and set up policy bank practice and trial bases to provide experience and materials for policy bank legislation.
