| 摘 要： | 分析了依法治校的内涵及其意义;探析了依法治校背景下的高校工会。认为维护功能是高校工会的基本职能,由此出发可以看出现行工会法及相关法律在社会保障制度、劳动法律制度等方面存在一些不足之处,如工会处于两难境地,劳动争议解决机制过繁等。文章还提出了立法建议,要进一步完善集体谈判与集体合同,确立与完善工会法法律责任,健全劳动争议仲裁委员会等。

| Abstract: | This paper starts with an analysis of the contents and significance of the policy of ruling the school in accordance with the law. The second part delves into the basic function of the college labor union under the policy, namely, the function of safeguarding the rights of the laborers. The third part discloses some flaws in the social security system and labor laws. Finally, some suggestions on the legislation are given for perfecting collective negotiations and collective contracts, establishing legal duties of labor union laws, and strengthening the arbitration committees for addressing disputes in labor, etc. |
