| 摘 要： | WTO反补贴规则把专向性作为采取反补贴措施的先决条件。中国入世议定书对我国国企补贴作了特殊承诺,将我国国企补贴视为有条件的专向性补贴,并允许其它成员方对我国实施反补贴措施时采取替代国数据计算补贴值,该承诺使得我国国企补贴政策在现行的WTO反补贴法律框架下极易招致其他成员方的攻击。此外,WTO有关国企私有化的反补贴规则也对我国的国企改制政策提出了挑战。为此,本文尝试提出现阶段我国国企补贴政策的调整思路及应对策略。

| Abstract: | The protocol on China's entry into WTO set out special provisions about subsidies to stated-owned enterprise,which are the provisions of an SOE-based specificity test and authorization for the importing country to use.In addition,the protocol excludes China from invoking the Privatization exception available to developing country members under the SCM.This paper makes an analysis of the protocol and available solution to the issues of SOE subsidies. |
