| 摘 要： | 在对我国农村妇女的土地流失进行了实证分析的基础上,指出了农村妇女在离异后无法在"夫家"重新获得土地,而失去了请求分割共同财产的权利。而婚姻法实行的是夫妻共同财产制,婚前财产不纳入共同财产范围,为此提出完善我国夫妻财产制度,确定在特殊情况下,夫妻一方的婚前财产可以纳入共同财产范围,已维护农村妇女的土地权益。
