隐私权限制中的利益平衡

个人隐私在某些情况下会涉及公共利益或他人利益,因此,法律在保护隐私权的同时,也需要对隐私权进行必要的限制。针对现实当中隐私权经常与其他权利发生冲突的情况,利益平衡原则应当被确认为隐私权限制的基本原则,主要包括公共利益优先,隐私利益与公序良俗、公众兴趣所体现的利益之间的平衡,隐私利益与新闻媒体利益的平衡,隐私利益与其他公民或组织的知情权益的平衡。
