| 摘 要： | 公益信托监察人被誉为公益信托受托人的“监督者”和受益人的“保护者”，其在建构和维系公益信托法律关系及其运行中具有十分重要的作用。从理论和实践两个角度，分析了公益信托设立监察人制度的必要性，并针对我国公益信托监察入制度存在的缺陷和不足，借鉴国外及国内相关立法经验，提出了完善我国公益信托监察人制度的建议。

| Abstract: | Charitable trust supervisors is known as the ＂supervisor＂ of charitable trust community and the ＂protector＂ of beneficiaries. It plays an important role in the construction,maintenance,and operation of the legal relationship in charitable trust. The necessity to establish the supervisors system is analyzed from theory to practice. Then,according to the deficiencies and shortcomings of charitable trust supervisors system in our country and in view of foreign and domestic legislative experience ,we provide some suggestions to improve our country＇s charitable trust supervisors system. |
