| 摘 要： | 法制现代化是当今理论界讨论的热点问题。要实现法制现代化，实现由传统人治型社会向法治型社会的转轨，关键是如何改造和继承中国传统的法律意识，因为社会的变革首先应该是观念的更新。在中国传统法律意识与现代西方法律意识的比较中，只有对传统的法律意识进行扬弃，才能形成社会主义的现代法律意识。

| Abstract: | legal modernization is a theoretical topic much talked about in China today.In the transition from the rule by men to the rule of law.the key of legal modernization is how to rebuild and inherit the tradional idea of law and its revolution is always the pre-condition of social reform.After comparing the chinese traditional idea with the modern western idea of law,this paper tries to develop some modern idea of socialist law. |
