| 摘 要： | 传统知识是一种与现代知识体系有着显著区别的知识系统,具有地域性、集体性、动态发展和非新颖性等特征。由于本质差异和制度缺位,传统知识与现代知识产权制度在法律和实践上存在诸多冲突,主要体现在权利授予和利益分配等方面。知识产权制度对传统知识保护具有双重性,既有积极作用也有消极作用,但积极作用相对有限。在现有知识产权制度中仍有保护传统知识的空间,可以采用专利申请中的主动披露制度、新传统知识概念、公有专利概念、地理标志和特殊权利制度等对传统知识提供保护。 |

| Abstract: | Traditional knowledge is a distinctive system from modern knowledge system,with the characteristics of localization,communality,dynamic and non-novelty.Due to the divergence in nature and lack of mechanism,conflicts exist in the law system and practice with intellectual property rights,mainly in the aspect of right attainment and benefit sharing.Intellectual property system plays dual roles in this sense,with positive and passive influence at the same time.The positive effect is limited,however.There are still positive elements for the protection of traditional knowledge,requirement of prior disclosure,new traditional knowledge,communal patent,geographical identification and sui generis system. |
