| 摘 要： | 诚信原则经学者的推崇,已渐被尊为＂帝王条款＂。然而笔者通过对现行中国场域的考量,以为＂私法自治＂——这一民法原教旨主义原则方是中国当前场域的核心原则,其对早日完成中国民法主体意识的重塑,配合＂市场模式＂的本质要求裨益甚巨。

| Abstract: | The principle of good faith has been canonized step by step by scholars as the ＂Terms Emperor＂.With an analysis of the development in current China,the present writer deems that the autonomy of private law,which is the civil law of original religionist,is the core principle in current China.This will greatly assist the country to rebuild the main-body consciousness more quickly and to adapt itself to the true demand of the ＂market modal＂. |
