| 摘 要： | P2P文件共享网络技术给用户提供了更为便捷的分享音频、视频作品的便利，也因此给版权人保护自己的权利带来新的挑战。美国在Napster、Grokster等案件中虽然最终都认定了P2P服务提供商的帮助侵权责任，但是法院的依据却不尽相同：美国制定DMCA的初衷是保护一定的网络服务商不受侵权指控，但P2P服务提供商却难以成为DMCA安全港规则保护的对象。在这场利益争夺中，版权人似乎取得第一回合的胜利，但是谁能最终胜出仍然是司法面临的一个重要问题。

| Abstract: | P2P file-sharing networks are convenient to communicate and share the copyrighted audio and video works online for the users, whereas they challenge the protection of rights of copyright owners, In the cases of America, the courts hold P2P providers＇ contributory infringement, but the judgements are based on different theories of infringement. The original intention of the DMCA of America is to balance the benefits between internet service providers and copyright owners and to protect internet service providers from accusation of infringement. However, the P2P providers have not readily been qualified by the internet service provider. The copyright owners seem to win the first round in this battle of benefits but what remains is who will be the final winner in the future. |
