论制定统一行政程序法典的宪法依据

依据宪法制定行政程序法,可以丰富行政程序法之价值内涵,提升行政程序法的合法性,创新宪法实施的路径。我国宪法中的人民主权条款规定了公民参与权,公众参与制度的内涵与之契合,为此行政程序法应设置公众参与程序;密切联系群众条款要求国家机关与公民保持充分的信息交流,交互式行政程序的机理与之相符,为此行政程序法应建构协商程序;精简原则要求国家机关之组织与程序的精简,与简易程序追求的便民、效率价值一致,为此行政程序法应设置简易程序。

On the Constitution Basis of Constituting the Uniform Administrative Procedure Law

Constituting Administrative Procedural Law under Constitution will enrich the value connotation of the Administrative Procedural Law, improve the legitimacy of the Administrative Procedural Law and creates new paths to implement constitution. The connotation of citizen participation system tally with the clauses of popular sovereignty, wh~ch mean-the Administrative Procedural Law must setup citizen participation system. Mechanism of interactive procedure conforms to the clause of keeping close to the People, so the Administrative Procedural Law should establish interactive procedure. The principle of efficient and simple administration demands every organ of state to realize their aim of simplification in organization and procedures which get according with the simplification procedure, so the Administrative Procedural Law should set a simplification procedure.
