| 摘 要： | 商事代理实践的迅速发展对我国代理商立法产生制度需求。商事代理立法从行为法走向主体法已经成为一个较具现实性的选择。我国现有的代理商制度立法无论在立法理论还是在规范结构体系上均存在缺失与不足。我国代理商法技术构造的重点是,从合理确立立法的理论基础出发,进而构建起代理商法定种类划分科学、规范体系完备的制度体系。

| Abstract: | The rapid advancement of trading agency practices has expanded the demand for the system of agency legislation. It can be regarded as feasible that the trading agency legislation will evolve into a main body law from a behavior law. Our country＇s agency legislation still has some imperfections not only in terms of the legislative theory but also in terms of the law structure system. As far as the technical construction of China＇s agency legislation is concerned, the key lies in constructing an institutional framework featuring scientific agency catagorization and a complete standardization system based on the theoretical basis of reasonable legislation. |
