| 摘 要： | 权利与对应义务的关系实质上是权利与权利关系的表现形式;它们的关系仅为全部法律关系的一部分,且不是最重要的部分;权利与对应义务实质上为社会个体之间的利益关系;权利与对应义务的绝对值是相等的;权利与对应义务在现实生活中是可以分离的;法的本位应是社会权利本位,它要求对法律承认和保护的利益应放在同等的位置.

| Abstract: | The relationship between right and relevant duty is essentially the manifestation of right and relations of rights,which is a less important part in the whole law relations.Right and relevant duty are a kind of relationship among individuals' interests,with equal absolute value.They are separatable in reality,while the standard of the law is actually that of social right,demending that recognition of law should be equal to protection of interest. |
